TORONTO - Possession of marijuana isn't going to be legal in Ontario any time soon.

The Ontario Appeal Court has stayed a lower court ruling that declared the federal medical marijuana program unconstitutional.

The Appeal Court says the Superior Court decision is suspended until the higher court rules in the case of Matthew Mernagh of St. Catharines.

Justice Donald Taliano had ordered that Ottawa fix the medical marijuana program or face the prospect of effectively legalizing marijuana.

No date has been set for the Appeal Court hearing.
