GUELPH, Ont. - A man has been acquitted in a shaken-baby death after the trial judge criticized the police interrogation.

Cory Armishaw, 26, was charged with second-degree murder in the death of Jayden Lindeman in November 2006.

The toddler was taken to hospital from his Hadati Road home after he'd been left alone with Armishaw.

He died two days later in London, Ont., from what doctors said was brain damage from being shaken.

Justice Kenneth Langdon said Monday that any confession from Armishaw was inadmissible because police repeatedly ignored Armishaw's desire to remain silent.

Armishaw had been advised by his lawyer not to say anything.
