The province's special investigations unit has cleared two Toronto police officers in the death of a man who was developmentally delayed.

Charles McGillivary, 45, died in hospital after an encounter with police outside a Bloor Street pizza restaurant in August 2011.

The SIU said on Wednesday that it has concluded there are no reasonable grounds to believe the two officers committed a criminal offense in the case.

Police had responded to a residence in the area of Bloor Street West and Christie Street at about 8:27 p.m. where they arrested McGillivary.

During the arrest, "They struggled with him and he would not permit them to place handcuffs on his wrists," the SIU said in a statement.

The officers managed to finally handcuff McGillivary after restraining him on the ground.

"Immediately after Mr. McGillivary was handcuffed, he fell into medical distress; his complexion turned purple and he lost consciousness," the SIU said.

Paramedics took McGillivary to Toronto Western Hospital where he later died.

An autopsy showed that McGillivary had an underlying heart condition.

"In sum, I cannot form reasonable grounds that the subject officers acted unlawfully notwithstanding this incident's tragic result," said Ian Scott, director of the SIU.
